Copyright and DMCA
How to tell us that something on Pipit infringes your copyright, and what to do if your content was removed by mistake.
Our designated agent
Send copyright notices and counter-notices in writing to our designated agent under the Digital Millennium Copyright Act (DMCA):
Ray Shingler, Pipit, Inc., 9660 Industrial Dr, St John, IN 46373. Phone: 219-309-7048.
What a notice must include
If you own a copyright, or are authorized to act for the owner, and believe material on Pipit infringes it, your notice must include:
- a physical or electronic signature of the copyright owner or of a person authorized to act on their behalf;
- identification of the copyrighted work you believe is infringed (or, if several, a representative list);
- identification of the material you believe is infringing, with enough detail for us to find it, such as its Pipit link;
- your name, address, telephone number and, if you have one, email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act on the owner’s behalf.
What happens next
When we act on a notice, for example by removing or disabling access to the material, we make a good-faith attempt to tell the person who uploaded it at the most recent email address they gave us. We may forward the notice to them or to third parties such as lumendatabase.org.
We terminate the accounts of people we consider repeat infringers.
Counter-notices
If your content was removed and you believe that was a mistake, or you have the right to use it, you can send a counter-notice to the agent above. It must include:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before it was removed;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of a mistake or misidentification; and
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if you are outside the United States, any judicial district in which Pipit may be found), and that you will accept service of process from the person who sent the original notice or their agent.
After a counter-notice
We may send a copy of your counter-notice to the person who sent the original notice. Unless they tell us they have filed a court action against you, the material is restored within 10 to 14 business days after we receive your counter-notice.
Before you send one
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. If you are not sure, consider talking to a lawyer first.
Other ways to reach us
You can also flag content quickly with Report in its … menu and choose Copyright, or email hello@indiepipit.com. These reach the Pipit team, but they are not a formal DMCA notice.
The full policy is in our Terms of Use. See also Pipit Support.
